Terms of Use Agreement
General
By clicking "Sign Up Now", "Become a chainstaff Member", "Register", or by accessing or using any of our services, you enter into a legally binding agreement with chainstaff AG, Switzerland ("chainstaff", "we", "us", or "our").
If you do not agree to these Terms, do not access or use our Services. You may terminate this agreement at any time by closing your account and discontinuing your use of the Services.
Services
These Terms apply to chainstaff.info, chainstaff apps, and any related websites, plugins, or digital services that refer to these Terms (collectively, the "Services"). This includes offsite data collection for such Services, such as analytics or advertisements, and plugins like "promote with chainstaff" or "share via chainstaff".
Registered users are Members, while unregistered visitors are Visitors.
Your Relationship with chainstaff
You are entering this agreement with chainstaff AG, Mohnstrasse 1, 3084 Wabern, Switzerland.
As a Visitor or Member, your use of the Services and any related data processing are governed by our Privacy Policy, our Cookie Policy, and any other documents referenced therein.
Modification
We may amend these Terms, our Privacy Policy, or Cookie Policy from time to time. If we make material changes, we will notify you through our Services or by other means, giving you an opportunity to review them before they become effective.
No changes will apply retroactively. If you disagree with any updates, you may close your account. Continued use of the Services after notice of changes constitutes acceptance of the updated Terms.
Eligibility and Access
Our Services are not intended for individuals under 16 years of age ("Minimum Age").
By using the Services, you confirm that:
- You have reached the Minimum Age required by applicable law.- You maintain only one account under your real name.- You have not been previously banned from using chainstaff.
If local law requires a higher age for lawful processing of your data or use of online services, the higher age shall apply.
All users, including companies, mediators, and applicants, are responsible for ensuring that all shared or posted content (including job ads and referral links) is lawful, accurate, and ethical.
Account Types and Responsibilities
There are three types of Members on chainstaff:
- **Mediators (chainstaffers)** – users who share job listings.- **Companies** – representatives who post job openings.- **Applicants** – professionals applying for open positions.
As a Member, you agree to:
- Choose a secure password and keep it confidential.- Not transfer or sell any part of your account.- Comply with applicable laws, these Terms, the chainstaff Code of Conduct, and Community Guidelines.- Use the platform responsibly and in good faith.
You are responsible for all activity under your account, unless you close it or promptly report misuse. chainstaff is not responsible for the accuracy of job postings or the conduct of mediators or companies. Users agree to indemnify and hold chainstaff harmless from any claims, damages, or liabilities arising from misuse of the platform.
Payments and Bounties
When purchasing paid Services or posting a job with a bounty, you agree to pay the applicable fees and taxes to chainstaff.
Payments and bounties are governed by the following principles:
- A 30% service fee is retained by chainstaff from the bounty amount.- The remaining bounty is distributed among eligible participants upon successful hiring via chainstaff.- The bounty is released in five equal installments: 1. Upon confirmed contract signing. 2. At the start of employment. 3. At the start of the 1st month. 4. At the beginning of the 3rd month. 5. At the beginning of the 4th month.
chainstaff reserves the right to adjust payment procedures as appropriate. No bounty is due for withdrawn job postings or unsuccessful hires. chainstaff may withhold the first installment until the candidate has started employment, to prevent fraud or abuse.
Refund Policy
If a candidate does not start employment or the contract ends within the first five months, the corresponding remaining installments will be credited pro rata to the company's chainstaff account balance.
If the company requests a bank refund, processing fees may apply. Payment disputes must be reported within 30 days of the transaction.
Notices and Communication
You agree that we may contact you:
- Within the platform, or- Via the contact information you provide (email, phone, or mailing address).
You are responsible for keeping your contact details accurate and up to date.
Member Responsibilities and Conduct
As part of the chainstaff community, you agree to act ethically and professionally. You may not:
- Create false identities, impersonate others, or misrepresent your affiliation.- Scrape, crawl, or copy content without permission.- Post or distribute malicious code.- Misuse referral links or spam third parties.- Claim affiliation or endorsement by chainstaff without written consent.- Violate privacy, intellectual property, or data protection laws.- Interfere with or overload our Services.
Users are expected to share job opportunities responsibly and refrain from any conduct that may harm the platform or other members.
User Compensation and Independent Status
chainstaff provides a digital platform that connects companies, mediators, and applicants. We do not employ mediators, referrers, or applicants — all Members act independently and at their own discretion. chainstaff does not control how, when, or where Members use the platform.
Any rewards or bounty earnings you receive may, under certain circumstances, be subject to income tax, self-employment contributions, or other obligations under applicable law. You are solely responsible for reviewing and complying with any such requirements in your country of residence. chainstaff does not withhold taxes or make social security deductions on your behalf. If you engage in frequent or regular referral activity, it could be interpreted as self-employment under applicable law.
It remains your responsibility to determine and comply with any registration, reporting, or licensing requirements that may apply to such activity.
Intellectual Property
You retain ownership of any content or information you post on the Services. By posting or submitting such content, you grant chainstaff a worldwide, non-exclusive, transferable, sublicensable license to use, copy, modify, distribute, publish, and process that content in connection with the Services, without further notice or compensation to you.
You may delete your content or close your account at any time. However, content shared with others may remain accessible until deleted by them or removed from backups. We do not include your content in third-party advertising without your explicit consent.
Availability and Maintenance
We may change, suspend, or discontinue any Service at any time. We do not guarantee storage or continued availability of any content. chainstaff is not a storage service and assumes no obligation to retain data except as required by law.
Third-Party Content and Services
Our platform may contain links or integrations to third-party websites, apps, or services. chainstaff is not responsible for their content, accuracy, or performance. Your interactions with third parties are solely between you and those parties.
Automatic Processing and Recommendations
We may use information you provide to personalize your experience, for example by suggesting job opportunities or potential matches. Maintaining accurate and complete profile data helps improve the relevance of these features.
Disclaimer of Warranty
chainstaff provides the Services "as is" and "as available", without any express or implied warranty. We do not guarantee that the Services will be uninterrupted, error-free, or secure. To the fullest extent permitted by law, chainstaff disclaims any implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, chainstaff and its affiliates are not liable for:
- Lost profits or business opportunities,- Reputational harm,- Loss of data, or- Any indirect, consequential, incidental, or punitive damages.
Total liability under these Terms shall not exceed the total amount paid by you to chainstaff in the twelve (12) months preceding the event giving rise to the claim.
Termination
Either you or chainstaff may terminate this agreement at any time. Upon termination, you lose access to your account and any Services.
The following provisions remain effective after termination:
- License rights previously granted to chainstaff.- Members' rights to re-share your content.- Sections concerning limitation of liability, indemnity, and governing law.- Any outstanding payment obligations.
You can close your account at any time through your account settings.
Governing Law and Jurisdiction
This Agreement is governed by the laws of the Swiss Confederation, excluding its conflict-of-law rules. Exclusive place of jurisdiction for all disputes shall be Köniz, Canton of Bern, Switzerland, to the extent legally permissible. If you access chainstaff from outside Switzerland, you are responsible for compliance with local laws.
If any provision of these Terms is found to be invalid, the remaining provisions remain in force. Invalid clauses shall be replaced by provisions that best reflect the original intent of the parties.
Miscellaneous
If any term of this Agreement is held unenforceable, it will be modified to the minimum extent necessary to make it enforceable while preserving its intent. Failure by chainstaff to enforce any right under this Agreement does not constitute a waiver.
You may not assign this Agreement without our consent. chainstaff may assign these Terms to its affiliates or successors without prior notice.

Code of Conduct – What You Can and Cannot Do
**Do's**
You agree to:
- Use the Services in a lawful, ethical, and professional manner.- Provide accurate information and keep your profile current.- Respect other Members and act transparently.
**Don'ts**
You agree not to:
- Create false identities or use multiple accounts.- Scrape, copy, or misuse platform data.- Circumvent access or payment systems.- Post harmful or illegal content.- Engage in spam, fraud, or manipulative behavior.- Misrepresent your affiliation with chainstaff.
